GENERAL TERMS AND CONDITIONS

Laura Ponchel Photography - Professional Photographer (Netherlands)


1. Purpose

These General Terms and Conditions (“Terms”) govern all photographic services provided by Laura Ponchel Photography, established in the Netherlands, to professional clients including companies, public and private institutions, NGOs, and other organizations. Any order implies full acceptance of these Terms.


2. Scope of Services

These Terms apply to all services:

- Professional event photography

- Corporate photography (portraits, locations, products)

- Visual content creation for internal or external communication

- On‑site or studio assignments

- Delivery and licensing of photographic material


3. Quotes, Orders, and Confirmation

A detailed written quote is provided outlining scope, pricing, logistics, and image usage rights. An order is confirmed upon written acceptance (email or signature) and payment of any required deposit.


4. Pricing and Payment

Prices are in euros (€) excluding VAT. Invoices are payable within 30 days unless otherwise stated. Late payments incur statutory Dutch interest and administrative fees.


5. Cancellation and Rescheduling

By Client:

- >30 days before the assignment: no fee  

- 30–7 days: 50% fee  

- <7 days: 100% fee  

By Photographer:

In case of force majeure, a replacement may be proposed or payments refunded.


6. Client Obligations

The client shall secure access to locations and obtain all permissions for photographing employees, participants, speakers, or visitors. The client is responsible for informing individuals about photography (GDPR compliance).


7. Execution of Services

The photographer provides services based on professional expertise. Obligations are “best efforts,” not guarantees of specific results.


8. Delivery

Images are delivered according to the agreed format and schedule, via secure online gallery or digital files. RAW files are not delivered unless expressly agreed.


9. Intellectual Property and Licensing

The photographer retains full copyright (Auteurswet – Dutch Copyright Act). The client receives a usage license defined in the quote, specifying internal/external use, duration, and territory. Any unauthorized usage requires written approval and additional fees.


10. Image Rights

The client is responsible for obtaining consent from identifiable individuals. The photographer cannot be held liable for the client’s failure to comply with GDPR or rights of publicity.


11. Liability

The photographer is not liable for indirect damages or financial losses.


12. Confidentiality

All client information is kept confidential unless disclosure is legally required or necessary for service execution.


13. Personal Data

Personal data is processed in accordance with GDPR. See Privacy Policy below.


14. Governing Law and Jurisdiction

These Terms are governed by Dutch law. Disputes fall under the jurisdiction of the courts of the photographer’s business location unless amicably resolved.
